Indian blogger v/s IIPM, whats up?

Well the whole indian blogosphere is into heavy discussions on this notice served by IIPM www.iipm.edu to Gaurav. They find him guilty for linking to a magazine called Just Another Magazine which wrote about the false information IIPM advertises about.

This notice is with respect to your releasing totally false articles about IIPM on the website blogspot.com (reference blogger.com) that has your clear reference and that has been released by you with proven deliberate and fraudulent intentions to harm the image of IIPM and related businesses. The articles have caused unfathomable damage to the reputation of IIPM and to its various operational areas. The articles further have affected innumerable future operations of IIPM.

Why are they mentioning the blogger.com or blogspot.com ? Why not the exact URL to his blog? Why not the exact reference to the post ?

We have legally notarized and logged all the releases and are sending you this email to you as the first notice of proposed legal, judicial and criminal action against you that has already been approved & cleared by the Post Graduate Fellow Programme committee at IIPM.

I don't know what do they mean by legally notorize? does that mean notorized by a notary ? I am not sure if the email was digitally signed. Will a email without a digital signature serve as a notice?

Even though the damage caused by your deliberate and fraudulent intentions cannot be calculated, the proposed filing would involve an immediate damage claim from you of Rs.125 Crores; apart from other various losses (including, but not restricted to opportunity losses, sales losses, legal costs and associated expenses). Corollary claims and subsequent parallel criminal and civil actions are being notified further on.

Wow how did they come with the number Rs. 125 Crores when they couldn't calculate.

We are also providing your details to respective national and regional police authorities for undertaking and implementing immediate arrest warrants against you. We are also providing your details to various corporations within India and abroad to inform them about the judicial, legal and police action against you; thus ensuring that your details are well documented.

Does that mean they have already given a police complaint? What are the other various corporations they are speaking about here? Are they threatening that you may not get a job in future?

Be warned, your telephone numbers, physical addresses thereon, login details, network access mechanisms have all been documented, notarized and legally ratified through google and blogspot.com, thus ensuring that any arrest warrants can be served and implemented on you within one day.

Did they really contact google ? can somebody confirm this ? Did Google's/Blogger's policy allow this ? As far as Blogger's privacy policy (http://www.google.com/privacy.html) speaks about the information sharing

The only point according to which google can share the information with IIPM is when forced by Law or by good faith. Since we this has not gone to the court yet, I don't think Google shared this information under the pressure of law.

That means it must be under the good faith ( if at all). Did IIPM contact Google directly to get the details ? Can this be possible ? Should I belive IIPM here?Probably we need write to google directly http://www.google.com/support
Other than this there has been lot of anger shown against the editor of JAM Magazine (www.jammag.com) which actually printed the article about the IIPM. The editors blog http://youthcurry.blogspot.com/ recieved some disgusting comments, attacking her personally. Which is can be agreed upon. Nobody can agree on this behaviour. Gentlemen please oppose, don't attack.
Even if I take this serving notice as ok, when I read about this post (http://gauravsabnis.blogspot.com/2005/10/update.html) about the blackmailing tactics of IIPM, my doubts gets stronger.

But apparently, the Dean of IIPM wrote him a mail saying that the IIPM Students Union had decided that if my blog posts were not deleted, then they would gather all the Thinkpads they had been given by the institute, and burn them in front of the IBM office in Delhi. Yes, that's right. Burn laptops!

Where is IIPM going to ? They are blackmailing IBM here to act against Gaurav. Is it right? Why don't they fight directly in court when they have already issued a notice? Why don't they claim their 125 Crore?

I have resigned from IBM. The decision is entirely my own and I was not asked by IBM to resign, nor was I pressured in any manner by any executive from IBM. I took the decision in view of some really bizarre threats that were apparently made by IIPM to IBM.

Well he has resigned now so that he can fight without involving IBM's name. Whole Indian blogosphere is supporting him for his fight for "free speech". I don't think IIPM can stand in the court. And I think even the IIPM knows it ( hence blackmailing stratagy). What a shame. Surprisingly no mainstream media has written about this. Is it because they were the earners from big advertisements of IIPM? Where is Indian media going?
